    Christopher E. Ballod, CIPP/US, CIPP/E is a partner in the Philadelphia and Pittsburgh offices of Lewis Brisbois and a member of the Data Privacy & Cybersecurity, Corporate, and Complex Business & Commercial Litigation Practices. 

    Data Privacy and Cybersecurity

    Mr. Ballod counsels clients in the prevention of data breach incidents, and during the response and notification process after an incident occurs. His experience protecting his clients' interests before an incident includes:

    • Negotiation and drafting of vendor agreements such as cloud data hosting agreements, software support agreements, telecommunications contracts, cloud-based human resources management services, and online reservation service agreements, providing for defense, indemnification, and response costs in the event of a data breach incident
    • Regulatory compliance counseling including compliance with HIPAA, payment card industry standards (PCI-DSS), NYS Department of Financial Services compliance, and the European Union's General Data Protection Regulation (GDPR) 
    • Counseling during the assessment of risks and placement of cyber liability coverage
    • Incident preparation counseling including "table top" exercises practicing breach response procedures, and multi-day stakeholder "boot camps" training key personnel in all aspects of risk management and response
    • Drafting of privacy policy statements
    • Preparation of terms of service agreements, Anti-Money Laundering (AML) policies, and ancillary agreements for web-based crowdfunding ventures
    • Transactional counseling including compliance assessment during due diligence

    After an incident occurs, Mr. Ballod works as part of the Lewis Brisbois response team to partner with data forensics experts and insurance professionals in order to assess the scope of the breach and to provide the appropriate response. His breach response experience includes:

    • Coordination of breach response services for clients of all market sizes and across multiple business sectors including construction, energy generation, financial services, healthcare, hospitality, municipal government, and retail
    • Breach risk assessment and regulatory reporting including response to enforcement actions
    • PCI Account Data Compromise assessment response and appeal for all major card brands
    • Defense of litigation

    Mr. Ballod's experience with technology matters is unique in the industry. In addition to litigating the first "virtual property" case in the United States, Bragg v. Linden Labs, he counseled multi-national vendors of goods and services in a virtual world game about their participation in a virtual currency exchange, and the legality of their gaming businesses under state and federal gambling laws.

    Mr. Ballod possesses the Certified Information Privacy Professional/United States (CIPP/US) credential required to perform ISO 27002 (“Information technology -- Security techniques -- Code of practice for information security controls”) audits. He also possesses the Certified Information Privacy Professional/Europe (CIPP/E) credential.

    Energy Sector and Construction Industry

    Mr. Ballod counsels clients in the construction industry with a focus on the energy sector. His experience includes negotiation and litigation relating to construction projects on behalf of contractors, design professionals, developers, and owners. He has developed a reputation for expertise with matters pertaining to engineering, procurement, and construction (EPC) agreements. His experience includes the following representative matters:

    • Negotiated a multi-million dollar liquidated damages claim arising out of the EPC agreements for two gas-fired power plants
    • Handled a multi-million dollar arbitration matter pertaining to the valuation of a power plant after alienation of the assets
    • Advised a contractor with a nationwide presence as to regulatory compliance, land use, and permitting issues arising out of multiple power plant projects
    • Conducted a risk assessment analysis for a nuclear and traditional fuel energy generation company in the acquisition of new generation assets
    • Counseled a telecommunications company in the negotiation of site agreement disputes with landowners
    • Handled a dispute involving residual value payments stemming from a power plant development project
    • Handled litigation arising out of indemnification and failure to procure insurance claims relating to power generation facilities in Eastern Pennsylvania
    • Litigated a dispute regarding responsible parties for a floor collapse in a partially constructed multi-story office building
    • Litigated terms of payment claims relating to a multi-structure Gulf state condominium project and two residential subdivision construction projects
    • Negotiated the asset purchase agreement for the acquisition of an industrial machinery repair company, and handled the dissolution of the acquired entity
    • Defended design professionals in numerous professional negligence claims

    Bill Brown was formerly Chief Information Officer & CISO at Veracode, a recognized Gartner Magic Quadrant Leader for Application Security.  He is responsible for making Information Security, Platform Operations, IT and Systems Engineering strategic assets in scaling Veracode’s SaaS platform. Bill has more than 25 years of management experience in Information Technology, Information Security, M&A Technology Integration, SaaS Operations, DevOps, Operations/Logistics and Compliance including FedRAMP, SOC2, SOC3.

    In 2010, Bill was recognized as a Computerworld Premier 100 IT Leader, an award that recognizes outstanding technology professionals who have successfully aligned technology with overall business goals to advance their company’s critical IT initiatives.

    Prior to joining Veracode, Bill was CIO at Avid where he and his team provided operational support for Avid's cloud offerings as well as maintained the continued alignment of information systems and business strategies to ensure the highest level of operational effectiveness.  Before Avid, Bill was at Iron Mountain where he served in several senior leadership roles, including CIO, and he has more than 25 years of management experience in information technology, operations/logistics and electronic commerce.

    He was a co-founder and executive vice president of PCs Compleat, a PC retailer/distributor acquired by CompUSA and has also held senior management positions at PC Connection, Send.com, JWP/Businessland and Merisel.

    Bill holds a MBA from Babson College and a Bachelor's Degree in mathematics from Bridgewater State College.

    Kirsten Davies is formerly the Group Chief Security Officer (CSO) for Barclays Africa Group, where she has been tapped to build and run an end to end security function to include cybersecurity, information security, fraud, analytics, and physical security (among others) for operations across the continent.

    Kirsten brings a unique blend of global leadership, business acumen, cyber security practitioner experience, and technology background to her role. She is a proven leader in guiding large-scale global transformation programs focused on cyber and information security, technology, business process, and organizational transformation.

    Prior to her role with Barclays, Davies served in two capacities at Hewlett Packard Enterprise (HPE), both as Vice President and Deputy Chief Information Security Officer (CISO) and as Vice President for Enterprise Security Strategy, heading up one of four
    worldwide, strategic customer-facing areas for HPE.

    In her tenure with HPE, she achieved the first-ever Cyber Security Master Agreement with the German Workers Council, now replicated across HPE’s 20+ Works Councils in EMEA, led the strategic overhaul and reorganization of the Cyber Security
    Program, and broadened the capability of “Next Generation Security”, including Insider Risk and the IT/OT convergence.

    Prior to HPE, Kirsten served as the CISO for Global InfoSec Strategy and Governance at Siemens. There she managed the global InfoSec Transformation Program to refine the culture, people, policies, processes and technical portfolio of information security. Prior to that, she held senior leadership positions at Booz Allen Hamilton and Deloitte Australia.

    Ms. Goodwine serves as the Chief Information Security Officer for the US Department of Agriculture.  She has over 26 years of Information Technology experience spanning private industry, contracting, active and reserve military service, and the federal government.  Her experience includes leading large IT organizations, developing agency-wide strategy and policy, establishing governance, overseeing cybersecurity operations, executing IT acquisition, and program management.    Prior to her current position, Ms. Goodwine served as a cyber advisor to the Marine Corps Systems Command leadership responsible for delivering capabilities to the USMC warfighter.  Her diverse roles include Commander of an Air Force Cyber Squadron, Lead Cyber Policy Analyst at Headquarters Air Force, Pacific Region Communications Planner, and USMC Program Manager/Regional Contracting Officer Representative. Ms. Goodwine received numerous awards and decorations for her leadership, innovation, technical expertise and creative problem solving skills.   Ms. Goodwine earned a Masters of Business Administration from William Carey University, Bachelor of Science in Computer and Information Science from University of Maryland, a Certified Information Systems Security Professional (CISSP) from ISC2, Project Management Professional (PMP) from Project Management Institute (PMI), and DAWIA Level 3 Certification in Information Technology from Defense Acquisition University (DAU). Ms. Goodwine is married to Air Force Chief Master Sergeant (retired) Rod Goodwine; together they have six children and one grandchild.

    Sally holds leadership positions with the U.S. Department of Commerce, National Institutes of Standards and Technology (NIST), National Initiative for Cybersecurity Education (NICE) Working Group for Certifications & Training, the Executive Women's Forum (EWF) for Information Security and IT Risk and supports the Hiring our Heroes, Cyber Patriot and the NSA GenCyber programs.  Recently, Sally joined the prestigious Board of Directors with Cyber Crime Support Network.

    Wanda Jones-Heath is the Deputy Chief Information Security Officer/Chief, Cybersecurity Division, Office of Information Dominance and Chief Information Officer, Pentagon, DC.  She leads Division comprised of military, civilian, and contractor personnel responsible for developing Air Force Cybersecurity policy and strategy for over 5,000 Air Force Information Technology systems.  She also manages the Air Force’s transition to the Risk Management Framework and provides oversight of the Air Force’s Assessment and Authorization program.

    Ms. Jones-Heath graduated from the University of SC in 1990 with a degree in Computer Science.  She began her Civil Service career as a Palace Acquire Intern as a information systems specialist in various functional areas.  She moved to Headquarters Air Combat Command, Langley Air Force Base, Va., in 1993.  There she held positions responsible for policy and guidance for security and network systems.  Prior to assuming her current position, Ms. Jones-Heath was the Program Manager, Defense Information Systems Agency.  Ms. Jones-Heath led the effort to establish a DoD Mobile capability to include infrastructure.  Her joint experience includes working in various positions at Ramstein Air Base, Germany.

    Adam S. Lee is Dominion Energy’s vice president and chief security officer.

    He directs the development and implementation of corporate security strategy and policies which protect the company’s physical and cyber assets, valued at $100 billion and spanning 18 states. He is Dominion Energy’s security and intelligence liaison with the U.S. government and federal, state, and local law enforcement agencies. Lee joined the company in this role in 2018. 

    Before joining Dominion Energy, Lee served as Special Agent in Charge of the Federal Bureau of Investigation’s Richmond Division. In 2018, he retired from the FBI after a career spanning 22 years in counter-terrorism, counter-intelligence, and cyber investigations and operations, in addition to specializing in cases involving political and governmental corruption, the Foreign Corrupt Practices Act, and antitrust violations.  Lee previously served as the FBI's executive over its national Public Corruption Program, overseeing the FBI’s most sensitive criminal investigations involving elected and appointed officials across the spectrum of government.

    Lee is a member of World 50, a private community for CEOs and C-level executives at globally respected companies to discover better ideas, share valuable experiences, and build relationships that make a lasting impact.  Additionally, he is a member of the International Association of Chiefs of Police, the Central Virginia Law Enforcement Executives Association, and the Federal Law Enforcement Officers Association. 

    Lee is a passionate supporter of our nation’s veterans.  He serves as Dominion Energy’s executive leader over its Veteran Resource Group, and, in 2019, he was appointed to the Board of Directors for the Richmond Fisher House, which supports families of veterans seeking medical care.

    Lee is an attorney licensed in the State of California. Prior to his career in national and corporate security, he served as a Fellow in the California State Senate and Counsel to the California State Allocation Board.  He is married to Melinda, and father of Finn, Abigail, and Virginia.

    Judge Mares is dedicated to utilizing her knowledge and experience to make a difference, not only as a district court judge, but as an advisory board member For Axon Global and HDHint. She is relentless in her quest for knowledge in the legal field as a judge and as a privacy, security, IoT and cybersecurity specialist.

    She recently completed a program at Harvard University's Kennedy School of Government, specifically created for senior executives in state and local government.

    Mares was appointed by Governor Hickenlooper as the Arapahoe County Public Trustee in Littleton, Colorado, and was responsible for an annual budget of $1.3 million. Approximately $70,000,000 flows through that office annually.

    She is a past president of the Colorado Hispanic Bar Association (CHBA)(2012) and the Hispanic National Bar Association (HNBA)(2015).

    The CHBA and HNBA advocate on diversity and inclusion on behalf of Latino lawyers and students interested in the legal profession as well as issues that affect the Latino community.

    She is a member of the National Association of Corporate Directors (NACD) as a governance fellow, and member of the International Association of Privacy Professionals (IAPP) and the National Cybersecurity Center located In Colorado Springs, Colorado.

    Most recently, Judge Mares and a group of mostly engineers, published a book entitled Women Securing the Future with TIPPS for IoT. The electronic version is available in June 2019 and the hardcover in July 2019.

Prior to joining CVS Health in 2013, Frank worked in the telecommunications sector as Chief Information Security Officer of Alcatel-Lucent and in the healthcare sector as Vice President of Global Information Security at Medco Health Services, Inc. (now Express Scripts.) Frank has also held Information Security roles in the banking sector at Dai-Ichi Kangyo Bank and Long Island Savings Bank. He obtained his Bachelor of Science degree in Information Systems Management from New York University.

    Anahi Santiago is the Chief Information Security Officer at Christiana Care Health System in Delaware, one of the country’s largest healthcare providers.  With over 20 years in the Information Technology field, Anahi has extensive experience in areas of cybersecurity, privacy, regulatory compliance, program management and infrastructure services.

    Anahi has overall responsibility for the organization’s information security program and strategic direction. She leads a team of high performing information security professionals in supporting Christiana's strategic initiatives by partnering with the business and managing risks, implementing policies and controls, and generating overall awareness.

    Anahi holds a BS in Electrical and Computer Engineering as well as an Executive MBA from Drexel University.  She is also an active contributor in several national information security and privacy organizations.

    James L. Turgal, Jr, was formerly Executive Assistant Director (EAD), Information and Technology Branch, entered on duty in March 1996 and was assigned to the Houston Division, working Organized Crime and Drug investigations.  Upon being promoted as a Supervisory Special Agent, he was assigned to FBI Headquarters, Office of General Counsel and the Counterterrorism Division, as the senior counsel for Domestic Terrorism Operations.
     

    In 2002, Jim was assigned to the Cincinnati Division as Chief Division Counsel, Media Spokesperson, and Supervisory Special Agent.  Four years later, he returned to FBI Headquarters to lead the Director’s Research Group. He later became the Assistant Special Agent in Charge of Administration at the Washington Field office. 

    In 2010, Jim was selected to serve as the Special Assistant to the Deputy Director, providing counsel on various national security, criminal, and administrative issues affecting the FBI.  One year later, he was designated Special Agent in Charge of the Phoenix Division, where he oversaw several high profile cases, including the shooting of U.S. Congresswoman Gabrielle Giffords.  In 2012, Jim returned to FBI Headquarters, as the Deputy Assistant Director of the Human Resources Division (HRD).

    In August 2013, Director Robert S. Mueller, III appointed Jim as the Assistant Director (AD) of the HRD.  During this time, he served as the AD and Human Resource Officer.

    On February 10, 2016, Director James B. Comey, Jr. announced the appointment of James L. Turgal, Jr., as the EAD of the Information and Technology Branch.

    Jim is also a FBI certified pilot.
